Strange, this guy gets banned, but the person that opened a thread seeking advise on his "shop-lifting" immigration advice, does not. Wonder what our standards are with regards to banning people.

Shoplifting does not divide EB population. But if you open a thread to pitch EB3 against EB2 then I think he should be banned. I can click the red triangle on top of post to report it because I do not think anyone in IV or any senior member has time to waste all day reading every post and deleting them.

It's been about an year the case has been closed. I can't expunge it for 4 more years. The attorney said it may not be under CMT. I think even though we expunge it, in future where ever we go, if asked that ever got arrested, we need to say YES right?

Who ever go for testifying before congress should hightlight the USCIS mis use of VISA numbers during 2004 and 2005 by approving all latest cases and even though there are pending old cases
so that it will not redo the same in future incase dates move forward??

It is typo.
I knew no one will believe it. But Ron is saying it from the beginning of this year that EB3I will move considerably briefly later this year. Check out the following thread.

this is my 10th year in the US & never had a single incident along the racial lines.. probably I lucked out.. However, I don't subscribe to this opinion of removing moustache..... I am proud of my bushy moustache & have had women admire that at/outside work.. But I do agree 100% on all the other points you raised..
Brother, I take the moustache part back, I put that in from the point of view of popular culture, because I have heard that the ladies like clean shaven men!! But If the opposite works for you - Enjoy and I hope you get lucky!!

Until this point of time, no one knows how USCIS or state is calculating the figures. So, lets wait and see the lottery results. Thats the only way to get the green card faster :)

In America - anybody can say a racial slur against you and they will not be prosecuted under law - you can also do the same without fear of prosecution. Although both of you might loose your jobs because you work for a private company - they have the right to fire anybody they want. First and foremost - please respect the freedom of speech - words dont kill!
Here are a few things that might help shut up folks who talk against you...
1) There is no reason to be overly sentimental about anything (being sentimental and having a sense of entitlement is a desi trait that needs to be gotten rid of as soon as you get off that plane at the airport - it is something that should not have been there in the first place. You are not special, this is not your country, the ppl over here are not dumb, you are here on business and maintain that attitude. If somebody misbehaves with you tell outside of work, them to f*** off - if somebody does that at work - you can reply to them without using abusive language - because abusive language might get you fired. If you HR is effective complain to them - but I prefer to handle it at an individual level - because I am not scared - thats the beauty of America)
2) Dress properly - get a haircut and dont use cooking oil instead of gel. Get rid of the moustache if you have one. Make sure you dont stink. Dressing up smartly elevates your image - remember this country is very image conscious - which I think it should be. Dressing nicely and smelling good will not hurt anybody. To all desi women - please get rid of all the facial + body hair that is visible. Please wear makeup - because you may not be naturally beautiful. Donot act like slobs - nobody likes that.
3) Respect boundaries and dont make other ppl smell your food.
4) Be positive in your attitude, improve your communication skills and dont act servile.
5) Most desis are hard working and responsible people - nothing should hold them back - not certainly the need for an image makeover.
All fellow desis take care and enjoy your life here - life is too short to be depressed about the green card everyday. Most important thing is you stay happy everyday - here or in India.

"Accordingly, if the employer withdraws the approved Form I-140 on or after the date that the Form I-485 has been pending 180 days, the approved Form I-140 shall remain valid under the provisions of �106(c) of AC21. It is expected that the alien will have submitted evidence to the office having jurisdiction over the pending Form I-485 that the new offer of employment is in the same or similar occupational classification as the offer of employment for which the petition was filed. Accordingly, if the underlying approved Form I-140 is withdrawn, and the alien has not submitted evidence of a new qualifying offer of employment, the adjudicating officer must issue a Notice of Intent to Deny the pending Form I-485. See 8 CFR 103.2(b)(16)(i). Nurses are part of EB. This nill has many benefits. More nurses will be out of greencard queue leaving others more chance. US has acute nurses shortage. It is well documented. There is not much shortage of IT professionals . Unemployment is so high. But nurses are in demand and it is important for the healthcare of the nation. Supporting the bill is a win win for everyone in EB wait.

First, there are many procedural votes and we are not always privy to the happenings behind the scenes. This was alluded to in other places.
Secondly, although it was defeated, there was a healthy simple majority and this augurs well for any reconciliation process.
Finally, any impetus for immigration provisions are likely to emerge form the house side, who have been seeing our plight up close. There are likley to be some behind the scenes arrangements made and the final agreement may look slightly different. For example getting Sen. Durbin's support by getting in the H1b restrictions will get the support of some more Democratic members, they could then proceed with the favourable provisions. All said however, it is likley they wil do this as a rider to some bill rather than in the glare of the public as a stand alone bill.
I just hope the staunch CIR folks, become a little more pragmatic and stop being a hindrance, and stop holding legal immigrants hostage to their issues. They after all call themselves pro-immigrant, right? Ironically convincing them of that seems to be our most difficult hurdle.

uscis works in funny ways (as we all know). As I stated in earlier post one case in nebraska i know got rejected and they stated that the appeals decision wasn't precedent. The texas cases received rfe's but got approved based on the decision.
Just yesterday, I received 140 denial from texas where they didn't even discuss the decision and just picked on that bachelors was three year degree.
Same case was with me. They picked on my 3 year bachelor degree. Can i do appeal after 2 years ?

You really cannot ask for more EB3 numbers or 'treat EB-3 fairly'...Laws are made by the congress and they provided certain numbers to each country & category. USCIS has to follow these norms and apply those numbers and USCIS has followed the rule and have applied the allocatd numbers to EB-3. Problem is not that they are treating us differently or we are getting an unfair treatment. The problem we are facing is because we are just too many in number and the problem is Congress didn't make any laws to provide relief to people if one country or a category becomes hugely backlogged...unfortunately, the Last time they did any law for EB immigrats, it was in 1999 or 2000 when they brought AC21. Since then there has been huge surge in immigration but everytime anything immigration related legislation was brought in congress, it has been shot down..In my opinion we can get relief only if congress acts upon it, USCIS is working the way there were tld by the congress

This can be a move to ask for more numbers for EB3 and to be treated fairly. My EB2 friends with 2007 priority dates are hopeful to get it next year and here I am in EB3 with no hope. There is no reason to be hopeful if we go by last 3-4 years of data as to what happened with EB3,.
One guy here provided with some numbers and logic. If its true that there are many more in EB3 than in EB2, then we must ask for more numbers. Its pure nonsense that an EB2 waits for x years and Eb3 waits for 3x.

As he says there is no reason to hope for anything in EB3 with spillover or anything. It will not spill into EB3. We must ask for fairness and at the same time push for removal of quotas for everyone.

These are not going to fix the issue at large about limited GC numbers.
We need to make sure bills like HR5882 get passed. So we need to focus on how to make this a central issue in current politics.
We need to do much bigger than a single day news ... something for which main stream media pays attention in +ve light.
