Guys,
Regarding Mathew Oh comments:
"...There is a possibility the DREAM Act could be passed, allowing the children of undocumented immigrants (who complete their high school educations in the United States)..."
How do you think the passage of the DREAM ACT could impact our situation ? If they pass this, they would allay a sizeable portion of illegal immigrants to get amnesty through their children (few millions). I am just wondering whether the illegal alien supporters would lose steam to support CIR after this ? Ironically, they would get a sizeable amnesty, overhelm USCIS with millions of applicants and probably make the passage of a CIR bill more distant. I can't think of something less advantageous to us than this. I hope I am totally wrong.
What do you guys think ?

Recent mid-term elections resulted in wins for the Democrats, who will take control of the U.S. House of Representatives and virtually the U.S. Senate as of January 2007. The ensuing two-year term, many believe, may be ripe for some sort of comprehensive immigration reform. President George W. Bush has been espousing all along the cause for comprehensive reform in this area. Most people recognize that there are immigration problems and governmental delays that exist. Most also believe that the system needs to be changed for the better. But just how this should be accomplished is not so easily agreed upon, and so it is a hot-button issue. Many of the hardliners, who took a strong anti-immigration position, lost the recent elections. But there are some who took this stance and won. It also is widely believed that many of the newly elected Democrats expressed anti-immigrant sentiments in their campaigns. Achieving any strong pro-immigration measures may prove to be more daunting than originally was anticipated; certainly more than many hoped it would be. Needless to say, we can expect 2007 to mark the beginning of a time for change and flux in the arena of U.S. immigration law. There is a possibility the DREAM Act could be passed, allowing the children of undocumented immigrants (who complete their high school educations in the United States) to obtain conditional "green card" status if they enroll in college or join the U.S. armed services. Both the Democratic and Republican parties seem inclined to help children. There are individuals, however, who are not willing to give any benefits to children of undocumented immigrants. Whatever the outcome, one thing is for sure – we can and should expect some debate on the matter of immigration law and policy in the coming year. Your input, therefore, is critical to the process. Whether your interest is as an employer or an employee or some other capacity, it is important to make your voice heard in Congress by eMailing, writing, or calling your U.S. senator, congressperson, or their immigration aides. Contact them regularly on issues that concern you and your business. That is a part of our democratic process. So, if you care, you must dare to go out there and do your part!

And also from my experience --- You got to keep poking the USCIS authorities for them to wake up and take your application to process.
Let me tell you my story:
My company applied for my extension after 1st 3 yrs of H1 last year in Sept. I expected to get extension before Nov and I had planned to go to India in December. Well the dec came and I did not have extension, but I went to India as I was supposed to hoping that the extension would just arrive. Dec over, Jan over, Feb over, I am sitting Idle at home in India. Then I called USCIS- the officer told that since I left the country while extension applied and my h1 has expired, it means I have abondoned my application.. What the f***. Well, later I started following up with my h1 company.
Finally my office Amin staff personally went into USCIS office, explaining my situation and also showing proof that the client is waiting for me to get back and start work, I got h1 extension approved on Jul 24th.. What a relief.
Ran to Chennai for stamping and flew into Bay Area. Next day Med appointments cause i was to file 485 before Aug 17th.
Oh Gosh! I could barely do that and my application reached the NSC on Aug 17th. Now got the receipt numbers.
So Unless you keep poking them You wont hear updates. Just my 2 points experience in the swarm of people here.

we have professional lobbyists. and they cost the erath.
and that is why we need contributions. as long people "don't believe" we don't succeed. it's up to you, it's your issue as much as mine. professionals cost a lot of money, and this thread is quibbling over 20 and 50 bucks. anyway who is the knight on the white horse coming to rescue us? it's just us buddy, and we have to do our best. i like your analytical thinking. we need you to join in and help. any number of volunteers is less imho...
.....if ppl want to contribute lesser amounts all they need to do is find some like minded friends pooling their resources and making it into a big one time contribution. I have tried to convince some of guys I know over here but to no avail....less said the better...also tried using the charm of a good bottle of scotch to do the job...no good.....but we need to keep trying......bickering will not lead us anywhere....

Afet 9/11 all immigration systems are interconnected with the state and federal court records and minute one is arrested his name is there.. 100%...Talk to an attorney in the morning and pm me.. To the best of my knowledge they make good money. I personally know so many examples where H-1s make more money than US citizens. Only exception would be the ones who are fulltime in Infosys type companies.

Yup, Gandhigiri will work.. We have lots of time in our hands.. British enjoyed their 300 year stay in India.. Lets enjoy our stay in US also.. at the hands of our employers, lawyers etc.. :o
Lets not hope for results just act. If Gandhi could drive Britishers out of India using this approach, USCIS is also made of human people and sure they will do something to lessen our pains.

another angle is that if the law itself violates the constitution - there is a separate procedure to appeal against such a law (like may suits going on in state courts on laws related to gay rights) - however USCIS would not be party to such a lawsuit since USCIS does not make laws. one would need not only a good immigration lawyer but also a constitutional expert for a venture like this.

In EAD form, they are asking about previous EAD info..like which service center, what date, GRANTED or REJECTEd etc.. Now I had two EADs..one is OPT and other one I got last year. I've the same question. It sounds pretty stupid that Indian government allows you to have Indian passport if you register the child within one year. Looks like the child has no say in the process. Also, once the child gets Indian passport, can she revert back to US citizenship and hold US passport by renouncing Indian passport? Or do she need to wait 18 years? Once the child holds Indian passport, then does she need to get US visa stamp to enter US? Also, can the child hold both US and Indian passport?
