Hi,
My wife needs to change her status from H4 to H1 as soon as possible (before 31st of March). Her current status is -
- H4 on passpost (expiring on 19th March)
- H4 extension approved till 2010
- She has an H1B approved till 2010 (no I94 with the approval notice as it was done when she was in India)
What are our options? These are what we know with pros/cons. Please add/correct.
1. Go for stamping to India.
This looks like the safest option as this is first time stamping. Both Mumbai and Delhi have 31st as first dates available for appt. Chennai is open but we have heard rejection rate is high. Please comment.
2. Go for stamping to Canada
She does not have a US degree and we have heard that first time stamping is difficult without it.

I am not one of those who can go advocate at places as I do not have luxury of it. I respect people who are going beyond their daily schedule and advocating, but what are the goals.
It is certainly not because I/others want to see the buildings that we are asking people to come to DC - and the people going in to the meetings will be advocating for their and your green card issues (whether you want it or not - these efforts will benefit everyone stuck in the EB backlogs including you!). Getting the green card backlogs cleared is the goal - and it is deplorable that after being a member since 2007, you do not know this.
I have been coordinating with IV for the past 2 years now and I have never had members (majority) - including you - once trying to find a way of helping in this cause. IV has had the campaign of meeting with lawmakers in their local districts at a time that is convenient for each member - IN THEIR OWN LOCAL TOWNS - and I can count my fingers and toes on how many have actually done it.
The sad part is that you come from a state that was successful in raising $1500 from members (in addition to the contributions to IV and air mile donations) and instrumental in sending 5 members fully funded to DC + 2 green card holders + 2 members buying their own tickets. The chapter is coming together in these circumstances and you are clueless....... of what is happening within your own state - Joining the chapter neither costs money nor effort, just the benefit of knowing what is happening within your state!
I however want to contribute not *donate* if I know what am I going after.

Now that I have talked about so many people....let me tell you what I did to freak out Aman.....
Sunday afternoon, Aman asked me to take out about 5,000 printouts of our documents and put them in 120 folders for the meetings on Monday. I started doing it but the printer was painfully slow. After a while, I figured it will take me hours to do it and I was getting restless because I go to gym daily and I had not worked- out that day. I decided to run upstairs to the fitness centre and get done with it.
I came back in about 1.5 hrs., and there was a big chaos - so many printouts flying around!! Aman looked tensed. Anyways, I worked 5 hrs straight and with the help of great volunteers there I was able to get all those 120 folders ready for the monday morning.
So much so for my Obsessive Compulsive Behaviour! Needless to say, I didnot work-out the other 2 days....didn't want people to know I am crazy :)

I have seen that same tendency on ,when I asked about that, I was told that once your PD is current the RD plays the final role, if my RD is before someones with a 2004 PD then mine is done first. Now the service guy was the one telling me that. Question is how much can we believe them. Obviously we are getting mixed info here.
Lets just hope we all get it soon and this confusion they are causing with all the mixed messages is over soon!

I don't mean to be pessimistic regarding your application, but it seems that USCIS is processing old PDs 2003 and 2004 without looking at RD ( if it is within the published processing time or not). so if you have a PD of 2004 or older, don't worry about your RD and they will touch yours soon, assuming I-140 already approved. but if you have a PD newer than 2004, it might be a while before they get to those even if your RD is before 06/08/07 (published)
Also regarding the service request. I did a SR back in February to get an update of my case and they asked me to wait 45 days to hear something. I called again today ( 60 days later) and it seems that SR I did disapeared ( I even have a reference #). Customer Service rep said they can start a new SR but not sure if it is gonna do anything. they will get to the application when they can. and right now they are precessing 2003 and 2004.

What concerns me are:
(1) My husband's approval & notice of receipt arrived at the lawyer's/employer's office, why is mine supposed to be mailed at my place?
Even my wife's H4 receipt notice/approval was mailed to our home address. My H1 approval went to the employer.
(2) The possibility of H1B being approved and the H4 disapproved since we are both currently here in the United States already.
Most likely it shouldnt unless primary applicant was out of status or other issues like not getting paid according to LCA etc.
(3) Do I have a real reason to be alarmed that I do not have an approval for H4 at hand? Is there a possibility that it's just delayed right now since the approval for H1B arrived just two days ago?
(4) How can I verify whether the lawyer filed for the H4 with the H1B?
3&4: I seriously doubt your attorney filed for H4 extension. He has to file for I-539 I believe for H4 extension which you have to sign. Do you remember doing that? If your attorney says he has filed for H4 extension, ask him for the receipt number so that you can track it online.
