Hi everyone,
I reviewed the text of the bill...and, to the best of my understanding, the Dream Act applies to both legal and illegal children. This bill is crucial for me. I am 27 years old and have been in the United States since age 1 (Yes, 26 years)...LEGALLY!!! My husband (i married another visa holder and changed my status about 5 years ago) and I have been pending for a greencard for about 2.5 years now (I'm not counting the other failed attempts)...and still no luck. I completed my bachelors degree in Psychology years ago and cannot work (my field of study is fairly common in the US...nobody I've come across was willing to sponsor for an h-1). Unfortunately, going back to my "home" county isn't an option for me because this is the only home I've ever known. Anyhow, I would really appreciate everyone's support...hopefully this piece of legislation can benefit people like myself and we can contribute to society as well. Thanks!! :)

Damn, man it feels like you are reading my mind.
Irrespective of the immigration impact and its direct effect on me, I have tried analyzing the situation at the macro level and I end up at the same conclusion.
Health care, immigration, social security insolvency etc. no one cares about anything. Companies want to bring skilled labor in and it is being decided by a lottery!! I mean give me a God damn break. In the supposedly knowledge-driven economy, skilled workers are being selected by a lottery!
Medical emergencies are the leading cause of bankruptcy and there is just talk on the issue, no action.
Farms are shutting down and moving operations to Mexico. So now the oil will come from Middle East, manufactured goods from China and food from Mexico. And people are Ok with that because "companies just need to pay higher wages to *American* workers" So on top of $ 4 /gallon gas, we will be paying $ 8 for tomatoes.
There are not the marks of a prospering or forward-looking nation. May be I am becoming cynical as I grow older and may be things are no better in other countries like Canada, UK etc. But sometimes I feel as if I am watching a bad comedy show in slow motion. I question myself if my son, a US citizen by birth, will end up growing in a 2nd world country.
America was built by immigrants who came here with no sense of entitlement...just hope.....whether it was the Jamestown settlers....the Bavarian farmers....the Irish escaping the potato famine....the East Europeans fleeing communism.....and the recent Indian, Chinese, Japanese and other Asian populations looking to escape corruption and nepotism back home....
I fail to see how people these days forget this....one of my good friends acknowledges that his grandparents came as refugees fleeing strife in Europe but at the same time curses immigrants for the current woes.....and this guy is not a racist....an entire generation has been brought up to use the i-word as the substitute for the n-word since that is now politically incorrect....:mad:
Like the Klan leaders of yesterday, the Lou Dobbs of today never desist in blaming the 'immigrants' for everything....:(

Also I heard a rumor that they are going to allow filing of i-485 for review first and then let you wait for the visa number. Hope it is true!

So do you mean to say that this is allowed in India? I mean polygamy. I never knew that.
Muslims (around 20% minority) have this special law accepted by indian democratic government. In fact persons from muslim community can marry upto 4 wives at a time. However I haven't seen this as a common practice. Not sure if that law is changed recently. I guess No other religion is allowed to do so in india. I remember reading some cases in newspaper where people from different religion have converted just to legally marry more than one persons in india.

I agree with you. It's not required by law to file any AC21 papers so the USCIS cannot do much. Also, the green card cannot be revoked after 5 years so by the time you apply for citizenship, the USCIS cannot do anything bad to you. Worst case, they will ask about it during the citizenship interview so it's a good idea to keep your employment offer handy. But it's very unlikely and I really doubt they can deny your citizenship based on this. That's why I see no drawbacks in not filing AC21 and no benefits in filing it if you know that I-140 won't be withdrawn. My advice would be to take an employment letter from current employer and keep it in case the USCIS asks for it. There is no need to cause troubles for yourself by letting the USCIS know about it.

If I file AC-21 Memo to USCIS and I got laid off from my previous job 14 days prior to 180days and started the new job 14 days prior to 180days and the petitioner employer will not revoke I-140, will that cause any issue?

Knowing that PD's aren't going to move forward drastically, we need to start working towards some thing drastic like a bill/amendment. Or we can sit and mull over it and wait until the second week of Aug (when Sep bulletin is announced) to show our frustration.
If your argument is correct, there won't be any need for recapture laws that we all are working for. If the unused can be given to the next year, no visa will get wasted. USCIS/DOS can just give the unused in family category to Employment category in the following year and vice versa.

I am a consultant on H1B with EAD now. In my office (a major bank in US) I am 200% safe than the employees there.. they live like what you said (thinking when their job is at risk) and I am there in the job for last 3 years with a bright future.. I never blame the situatiuon I am in..
My view is " I have not born to live in A country or work for A company" I will always find my way out..
We bought a house recently and I know how many of my friends look at us and sigh a breath as they cannot do what they want for the fear of GC..
We are one happy family with our kids running around the house like they do in India...
just my thoughts.. not to meant to hurt anyone..
I dont expect everyone to agree with me - esp those who already have houses. my point was for those who are renting to keep on renting.
btw you can also rent a house - and those are quite cheap too nowadays.

Well.. it didn't turn out to be a major issue after all. At least for us. Both my self and my wife got approved in May. The first LUD since FP was on the day we were approved.
I do understand that 'not working' immediately after getting H1B is a problem and considered out of status and in addition you can also work while SSN is pending. However, most employers do not know about work with out SSN (pending) and according to some lawyers, we may be able to fight for this.
As I investigated further, there are so many people in the similar situation esp. spouses, i.e., getting on payroll a little late etc. Many of them for genuine reasons (though you will find fault with those reasons) and fell into unknowingly. However, most of them got GCs with out any problem.
The trick may be to put forward the documentation in such a way that it will not raise any flag. You require to submit Paystubs, w2s, tax returns only for primary applicant as supporting documentation I134 (affidavit) to prove that the dependent is not public charge. You need to make sure that information entered in the any forms (I485, Bio, I-134 etc) agree with supporting documentation such as I94, I797, PP/Visa or any documentation you included. If information do not match, it may raise a flag and IO may ask for more information. So do not get overexcited and submit only what is asked. YOU SHOULDN'T LIE. JUST SUBMIT ONLY WHAT IS ASKED.
I do understand the forms are useful, but I honestly feel that it is unnecessary stress. As I mentioned I was never been under so much stress as I was when folks pointed that we may not get GCs. I didn't sleep for couple days.. And stopped visiting this forum. Later my wife made me realize that family life is most important as long as we are together, country of residence does not matter. When our son was born last month, I truly felt 'damn GC'.. funnily got approved in the same week :).
There are few people who are truly helpful, but most come to forms just for kicks and show of their knowledge and talk/act like lawyers. My suggestion is DON'T HURT PEOPLE WHO COME FOR HELP. Esp, when there is something negative, don't try to prove and re-prove your point or satisfy your ego with logical answers or internet search results etc. This will hurt the person 'in trouble' even more. Just imagine your self in similar situation, then you will realize that most people get into situations unknowingly and probably unaware of till some one like you points out. Try to offer some suggestions if you can or stay away. If you want kicks, have a drink and watch a game or something. THANKS FOR READING THIS.

We appreciate ur apprehension, but please do not sow unnecessary seeds of doubt. As it is, making most legal immigrants take part in this struggle, is like milking a male buffalo.
If you feel that these efforts are being wasted, then you are free to watch from the sidelines. Pls do not take this as a personal attack on u, but you are one of many many such immigrants who are sitting on this fence.
Regarding the professionalism shown by people here, i would really ask you not to attack without fully understanding the efforts taken by people who have formed this group. People have been travelling back and forth to DC to try and establish a lobbyist firm. Instead of criticizing please do your part by helping and doing something.
People have been approaching their communities for help, researching pro-immigrant organizations and working with them to get support. Even arranging for news sites to do something for us.

just FYI..sanjose rally which i also attended and flower campaign( IV members and supporters) was the main and only reason why government change the july visa bulletin by accepting application till august 17th.Luckily i was able to file in that period. I got my reciepts but still waiting for finger printing notice and all and I know if we will not do anything final GC will take another 10 years...so please keep doing this and participating when you can and hats off immigration voice

I can second that. I do have an inactive discover card (I have not activated the new cards they sent to me as I have better cards to use). I have had discover cards for years. Just recently, a person from Discover Card called me to offer me those 5% reward cards. I said sure. Then she asked me if I was a citizen. Then she asked if I was a permanent resident. After two nos, she said then I can't give you the card.
Discover does not issue a credit card if you are not a PR or citizen..even though you have good credit history..
